Important Clarification Regarding Hotels as Essential Businesses:
While the Department of Health press release announcing the “stay-at-home” order did not list hotels as essential businesses, the official order DOES list hotels as essential. The order also provides some additional clarification about whether health care workers responding to the COVID-19 crisis count against the 50% occupancy limit.
The language from the actual order:
“Hotels, motels, RV parks, and other places of lodging shall not operate at more than fifty percent of maximum occupancy. Health care workers who are engaged in the provision of care to New Mexico residents or individuals utilizing lodging facilities for extended stays or as temporary housing shall not be counted for purposes of determining maximum occupancy.”
